Use of ANZ FX Online Dealing to enter into transactions is
conditional on you and one or more members of the ANZ Group having entered into
a written ANZ FX Online agreement ("Agreement") setting out the terms
and conditions governing use of ANZ FX Online services by that User.
Where such an Agreement has been entered into, all use of ANZ FX
Online services is subject to the terms and conditions of that Agreement.
In New Zealand, ANZ FX Online Dealing is supplied by ANZ National
Bank Limited and use of ANZ FX Online Dealing by New Zealand
residents is therefore conditional on you having entered into a written
Agreement with ANZ National Bank Limited.
In the United Kingdom, the ANZ Group is regulated by the Financial Services
Authority for the conduct of investment business in the United Kingdom. In the
United Kingdom ANZ FX Online is only available to intermediate
customers and market counterparties and is not available to private customers as
defined in the Financial Services and Markets Act 2000. Private customers should
not rely on any information contained on the ANZ FX Online website.
Where a written Agreement has not been entered into by you, your use of any
information, graphics, materials and functionality forming part of ANZ FX
Online is governed by the following terms and conditions and the ANZ Website
Terms of Use and the ANZ Privacy Statement for the web site operated by
Australia and New Zealand Banking Group Limited (ABN 11 005 357 522) under the
domain name "www.anz.com". You acknowledge and accept that your use of
ANZ FX Online indicates your acceptance of the applicable terms and
conditions.
If your use of ANZ FX Online does not require a digital
certificate, ANZ will give you a password ("ANZ Password") to enable you to use
ANZ FX Online. You must not send or disclose your ANZ Password to any
other person. You must not keep your ANZ Password in any form, whether encoded
or unencoded, in a location where it is capable of being copied or used by any
person other than you. You are solely responsible for any loss caused by use of
your ANZ Password by you or any other person, including any use not approved or
contemplated by you. You must immediately notify ANZ if you know that your ANZ
Password has been compromised or become known to a third party, or if you know
of any unauthorised use of your ANZ Password. In these circumstances you must
immediately change your ANZ Password.
When you are connected to ANZ FX Online, after a period of
inactivity you may be automatically disconnected (timed-out) from ANZ FX Online. ANZ is not responsible for any loss of data or other material that
may occur as a result of such disconnection.
